Abstract

According to the Shari'ah law to the ownership, every individual, man, and woman, Muslim and non-Muslim have right to own a piece of land. Thus there or several modes for the Acquisition of a land. Among those modes one is rehabilitation of the lands uncultivated and not owned   by anyone, which called ehya’ul mawat. This study aimed to explain the rules of this mode, and to compare the rules of shamilat in Contemporary   land ownership laws in pakistan. The sayings of prophet ﷺ about ehya’ul mawat are narrated in Sahihul Bukhari and other books, This study is mostly from the commentary of sheikh abdul khaliq bajawri in his book Ghunyatul qari; the interpretation of Sahih ul Bukhari.
