Abstract

Javed Ahmad Ghāmīdī's commentary on "Al-Bāyān" presents a unique and contemporary perspective on women's rights. In the light of the Holy Qūrān, Ghāmīdī recognizes women as complete human beings, possessing equal natural rights and socially independent individuals. In family and marital laws, he sees women as honorable life partners rather than mere subjects or subordinates. His commentary places special emphasis on marriage, divorce, khula, inheritance, iddāh and the mutual rights and duties of men and women and in every case, the principles of justice, kindness and consent are the basis. According to Ghāmīdī, marriage is a bilateral contract in which the consent of the woman is the first condition. In the case of divorce, he gives both men and women the right to separate and considers khūlā to be an honorable path. In interpreting the rules of inheritance, he takes into account the cultural background of the time of revelation and advocates for equal principles in the present era.Ghāmīdī critically examines social customs and traditional jurisprudential interpretations and presents a vision of a just social system for women based on the direct guidance of the Qūrān.This study shows that in "Al-Bāyān", Javed Ahmad Ghāmīdī has presented women's rights in a new way and has provided a balanced, reasonable and modern perspective on the position and status of women in Islamic society. This article provides an analytical study of Javed Ahmad Ghamidi's views on various aspects of women's rights.
