Gender identity and transgender issues have become significant global concerns, especially with the growing recognition of transgender rights and the increasing acknowledgment of gender fluidity. This paper examines gender identity and gender transition from both Sharīʻah (Islamic law) and legal perspectives, with a focus on the Transgender Act 2018 in Pakistan. The study explores the issues related to gender incongruence and gender transition according to Islamic jurisprudence, while also analyzing the legal framework established in Pakistan for the protection of transgender individuals' rights. The paper reflects on the rights and status of transgender people under these laws and examines the growing social implications of these developments. The purpose of this study is to shed light on both Sharīʻah perspectives and modern legal practices, and to explore how both systems can work together to protect the rights of transgender individuals and guide them back to their natural identity.
