Abstract

Child marriage remains a significant issue in Khyber Pakhtunkhwa (KP), despite legal measures aimed at curbing the practice. This research critically analyzes the existing child marriage laws in the province, identifying legal loopholes and socio-cultural barriers that continue to undermine the effectiveness of these laws. Although Pakistan has set a minimum legal age for marriage, the enforcement of these laws remains weak in KP, largely due to traditional practices, deeply rooted cultural beliefs, and a lack of awareness. The study explores the gap between the legal framework and its implementation on the ground, highlighting the role of local customs, family pressures, and limited access to justice in perpetuating child marriage. It also examines the legal inconsistencies in the application of marriage laws across different regions of Khyber Pakhtunkhwa (KP). Furthermore, the research discusses how these barriers affect the protection of children's rights, particularly the rights of young girls, and the long-term social and health consequences of early marriage. The article proposes a need for stronger legal enforcement, awareness programs, and cultural shifts to ensure that child marriage laws are not only present but also actively protect children in the province.
